These Terms govern your use of the Website. Part A applies to everyone who uses the Website. Part B applies in addition when you donate, and Part C when you are a beneficiary or a volunteer. Please read the parts that apply to you before using the Website.

Definitions

Part A — For everyone

Accepting these Terms

By using the Website you agree to these Terms. If you do not agree with any part of them, please do not use the Website. Your use of the Website is also subject to our Privacy Policy, which explains how we collect, use and protect your personal data.

Anyone may browse the Website. If you are under 18, a parent or guardian must make a donation, register as a volunteer or apply for help on your behalf.

Using the Website

You agree not to misuse the Website, including by giving false information, pretending to be someone else, interfering with its working or copying its content for commercial use. We may suspend or end your access at any time, without notice, if you break these Terms.

The Website may occasionally link to other sites. We do not control them and are not responsible for their content.

Availability of the Website

We work to keep the Website accurate and available, but we do not promise that it will always be available, free of errors or free of viruses, or that information on it will always be complete or current.

Part B — For donors

Your donation

A donation is a gift towards a cause, not the purchase of goods or of a service. When you donate, you confirm that the money is yours to give and that the details you provide are accurate.

How the work is carried out

Our field teams carry out each service to the standards we set and monitor ourselves, and we send you photographs or videos of the service as proof. The choice of beneficiary, the items given, their quantity and quality and the time and place of the service are decided by the Foundation. We do not accept claims about these matters once the service has been carried out.

Fundraisers for individuals and other organisations

Some campaigns raise funds for an individual, such as for school fees or medical treatment, or for another organisation. We check the requests we publish, but the information in a campaign is provided by the beneficiary or the organisation, and we are not responsible for its accuracy or for how an individual or another organisation uses the funds once they are paid over.

Refunds and cancellations

Donations are covered by our Refund Policy, which sets out when a donation can be returned, when it cannot, and how to ask.

Limitation of liability

To the extent permitted by law, the Foundation is not liable for any indirect, incidental or consequential loss arising from your use of the Website or from a donation, and our total liability to you for any claim is limited to the amount of the donation the claim concerns.

Part C — For beneficiaries and volunteers

Applying for help

If you apply for funds, or someone applies on your behalf, you confirm that the information and documents given are true and complete. We may verify them, ask for more, and decline or stop a campaign at any time, including if any information turns out to be false. Raising funds does not guarantee that a target will be met, and we decide how and when funds raised are applied to the need described, including by paying a school, hospital or supplier directly.

Photographs and personal data

Beneficiaries may be photographed or filmed while receiving help, and these photographs and videos are shared with donors and used in our communications and marketing, including on social media and in advertisements. Our field teams take photographs openly, and a beneficiary who sees this and comes forward to receive help agrees to be photographed and to this use. A beneficiary who does not want to be photographed may tell the field team, and will still receive help. How to ask us to remove a photograph later is explained in our Privacy Policy.

Volunteers

Volunteers take part without pay and must follow the instructions of our field team, treat beneficiaries with respect and protect their privacy. A volunteer must not collect money in the Foundation's name or share photographs of beneficiaries except as we allow. We may end a volunteer's participation at any time.

Part D — General

Governing law and disputes

These Terms are governed by the laws of India. If you have a concern or dispute about the Website, please contact us first so we can try to resolve it informally. A dispute that cannot be resolved this way will be referred to arbitration under the Arbitration and Conciliation Act, 1996, seated in Chennai, and subject to that, the courts at Chennai have exclusive jurisdiction.

Severability and waiver

If any provision of these Terms is found to be unenforceable, it will be applied to the greatest extent possible and the rest of the Terms will remain in force. If we do not enforce a right under these Terms, that does not waive our right to enforce it later.

Changes to these Terms

We may update these Terms from time to time. We will post the new version on this page and update the "Last updated" date above, and for a significant change we will make reasonable efforts to give 30 days' notice. If you keep using the Website after a change takes effect, you accept the updated Terms.
